We are pleased to inform you of a historic victory for Capetown residents. The Hon’ble ECGRF, in Case No. 24-Noida/2020, has delivered a landmark order in favour of Capetown AOA against M/s Supertech Ltd.
🔹 Key Directions of ECGRF
• Builder must provide complete account details of all electricity collections since 2015 within one month.
• Disclosure of flats billed, recoveries made, and unpaid builder flats.
• Monthly payment details to PVVNL to be shared.
• Audited accounts every 6 months, open for flat owners’ inspection.
• Excess collections beyond 5% to be refunded within one month, with 9% interest compounded monthly.
• AOA to be the custodian of refunded amounts (not to be used for infrastructure works).
• Fixed charges (Grid & DG) to be strictly on No Profit, No Loss basis.
• Failure to comply empowers residents to initiate criminal proceedings against the builder.
🔹 Background of the Struggle
• Residents have been fighting since 2016 for transparency in the prepaid electricity system.
• Complaints filed before Executive Engineer, Noida Authority, PVVNL, and District Administration.
• In 2017, residents obtained a favourable order from the Executive Engineer, but the builder failed to comply.
• In 2019, Capetown AOA escalated the matter to MD PVVNL and even approached the Hon’ble Union Power Minister, Shri R.K. Singh Ji.
• Despite repeated defiance by the builder, the matter was taken to ECGRF, resulting in this landmark ruling.

• Since M/s Supertech entered CIRP in March 2022, AOA has already filed claims before the Learned IRP and subsequently before the Hon’ble NCLAT, relying on this ECGRF order.
